Terms of Service

These Terms of Service ("Terms") govern your use of Abstractify ("the App"), developed by Bennett Waisbren ("we," "us," or "our"). By downloading or using the App, you agree to these Terms.

1. Description of Service

Abstractify is an iOS application that transforms photos into abstract line art using AI-powered image processing. The App offers both free and premium subscription tiers.

2. Eligibility

You must be at least 13 years old to use this App. By using the App, you represent that you meet this requirement.

3. User Content

Your Photos

• You retain all ownership rights to the photos you submit for processing
• You grant us a limited, temporary license to process your photos solely to provide the transformation service
• We do not claim any ownership of your photos or the generated artwork
• You are responsible for ensuring you have the right to use any photos you submit

Generated Artwork

• The abstract artwork generated by the App is yours to use as you wish
• You may share, post, print, or use generated artwork for personal or commercial purposes
• We do not claim ownership of artwork generated through the App

Prohibited Content

You agree not to submit photos that you do not have the right to use, contain illegal content, or violate the rights of others.

4. Subscription Terms

Free Tier

• Unlimited transformations
• Generated images include a watermark
• Images are optimized for social sharing (512px)

Abstractify Premium ($4.99/month)

• Watermark-free exports
• Full resolution output (1024px)
• Priority cloud processing

Billing

• Subscriptions are billed monthly through your Apple ID account
• Payment is charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless canceled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your Apple ID Account Settings

Cancellation

• You may cancel your subscription at any time through your Apple ID Account Settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial billing periods

5. Intellectual Property

Our Rights

The App, including its design, features, and the AI model used for transformations, is protected by copyright and other intellectual property laws. The artistic style produced by the App is based on Bennett Waisbren's original artwork. You may not copy, modify, or reverse engineer the App or its underlying technology.

Your Rights

You own the photos you submit and the artwork generated from them. Nothing in these Terms transfers ownership of your content to us.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, THE RESULTS WILL MEET YOUR EXPECTATIONS, OR ANY ERRORS WILL BE CORRECTED.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Our total liability shall not exceed the amount you paid for the App or subscription in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless Bennett Waisbren from any claims, damages, or expenses arising from your use of the App, your violation of these Terms, or your violation of any rights of another party.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Effective Date." Your continued use of the App after changes constitutes acceptance of the new Terms.

10. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
